29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(g) and (h) will be met:  a) On or about February 21, 2025, at the jobsite located at 2640 S. Bayshore Drive, Miami, FL 33133, the employer did not develop and implement a written hazard communication program for protecting an employee who worked with  hazardous chemicals to repair boats, including but not limited to, Awl-Fair Global Standard Converter (Stock code AWLD7200Q), Awl-Fair Global L/W Epoxy Fairing Compound/White Base (Stock code AWLD8200Q), Polyester Resin White HDN (Stock code GOHGK102374), AWL- Cat#2 Standard TopCoat Spray Converter (Stock code AWLG3010G), Awlgrip Std Reducer for Sprayed Urethane Topcoats(Stock code AWLT0003G), Awlcraft 3000 Snow White 3000(Stock code AWLTF8001G).

29 CFR 1910.1200(g)(8):   The employer did not maintain in the workplace copies of the required safety data sheets for each hazardous chemical, and did not ensure that they were readily accessible during each work shift to employees when they were in their work area(s):   a) On or about February 21, 2025, at the jobsite located at 2640 S. 29 CFR 1910.1200(h)(1): Employees were not provided effective information and training on hazardous chemicals in their work area at the time of their initial assignment and whenever a new hazard that the employees had not been previously trained about was introduced into their work area:    a) On or about February 21, 2025, at the jobsite located at 2640 S. Bayshore Drive, Miami, FL 33133, an employee who worked with hazardous chemicals was not effectively trained and informed as evidenced by, among other conditions; employee lacked knowledge of availability and location of safety data sheets and the employer's hazard communication program; employee lacked knowledge of the hazards presented by chemicals used.
