29 CFR 1910.1200(e)(1):Employers shall develop, implement, and maintain at each workplace, a written hazard communication program which at least describes how the criteria specified in paragraphs (f), (g), and (h) of this section for labels and other forms of warning, safety data sheets, and employee information and training will be met, and which also includes the following: a) On or about February 24, 2025, the employer failed to develop, implement, and maintain a written Hazard Communication Program for employees handling chemicals, including but not limited to brake cleaner (flammable, toxic), propane (flammable), asphalt (thermal hazard, respiratory hazard), and antifreeze (toxic).

1910.1200(h):Employee information and training. (h)(2): Information. Employees shall be informed of: (h)(2)(iii): The location and availability of the written hazard communication program, including the required list(s) of hazardous chemicals, and safety data sheets required by this section. a) On or about February 24, 2025, the employer failed to provide effective training and information specifically they did not provide location of SDS in the facility to employees who handle hazardous chemicals, including brake cleaner (flammable, toxic), propane (flammable gas), asphalt (flammable when heated), and antifreeze (toxic). As a result, employees were unaware of the specific hazards, required protective measures, and other information provided by the safety data sheets.
