29 CFR  1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b).  Instance A: On or about March 3, 2025 and at times prior thereto, employees were preforming shingle roof work to a 3 story apartment building at a height above 6 feet without utilizing fall protection.  Instance B: On or about March 3, 2025 and at times prior thereto, employees were preforming shingle roof work to a garage roof of an apartment building at a height above 6 feet without utilizing fall protection.

29 CFR  1926.1053(b)(1):Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed.  Instance A: On or about March 3, 2025 and at times prior thereto, employees were accessing the roof of  a 1st floor garage at heights above 6 feet in height to perform shingle work by utilizing an extension ladder that was not set up to extend at least 3 feet above the upper landing surface.  Instance B: On or about March 3, 2025 and at times prior thereto, employees were accessing the left side top roof of a 3 story apartment building to perform shingle work by utilizing an extension ladder that was not set up to extend at least 3 feet above the upper landing surface.

On or about March 3, 2025 and at times prior thereto, employees were utilizing an extension ladder to access the right side roof of a 3 story apartment building to perform shingle work in a way that exceeded the intended load of the manufacturer's rated capacity.
