29 CFR  1910.106(d)(4)(iv): Every inside storage room was not provided with either a gravity or a mechanical exhaust ventilation system. Such system was not designed to provide for a complete change of air within the room at least six times per hour. A mechanical exhaust system was not controlled by a switch located outside of the door. The ventilating equipment and any lighting fixtures were not operated by the same switch. A pilot light was not installed adjacent to the switch when Category 1 or 2 flammable liquids, or Category 3 flammable liquids with a flashpoint below 100 �F (37.8 �C), were dispensed within the room. Where gravity ventilation was provided, the fresh air intake, as well as the exhaust outlet from the room, were not on the exterior of the building in which the room was located:  a) Paint Mixing Room: On or about March 3, 2025, employees were exposed to respiratory hazards where the ventilation system to the paint mixing room, where Category 2 flammable paints including but not limited to Dynamic Clearcoat and SPECTRA-PRIME Low VOC Primer (Part A) Black were stored, was not functional.  b) Paint Mixing Room: On or about March 3, 2025, employees were exposed to exposed to fire hazards where the ventilating equipment and lights in the paint mixing room, where Category 2 flammable paints including but not limited to Dynamic Clearcoat and SPECTRA-PRIME Low VOC Primer (Part A) Black were stored, were not operated by the same switch. Two separate switches turned on either the lights or the ventilation system.

29 CFR  1910.134(e)(1): The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace:  a) Garage: On or about March 3, 2025, the employer did not provide medical evaluations to employees required to wear 3M 5300 or 6300 half face respirators that were spray painting. Employees were exposed to inhalation hazards while working with paints which contain titanium dioxide, n-butyl acetate, and acetone.
