29 CFR  1910.95(c)(1):The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.95(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent:  a.) Sawyer, Casters Sawmill Inc, 6323 U.S. 11, Sandy Creek, NY, 13145 on or about 3/25/2025; A sawyer was exposed to a continuous noise level at a 80.28% dose and approximately 88.42 dBA calculated as the 8-hour time weighted sound pressure level for a sampling period of 299 minutes. A zero increment was used for the 181 minutes not sampled.  The employer did not administer a hearing conservation program.  b.) Tailor, Casters Sawmill Inc, 6323 U.S. 11, Sandy Creek, NY, 13145 on or about 3/25/2025; A tailor was exposed to a continuous noise level at a 74.94% dose, approximately 87.92 dBA calculated as the 8-hour time weighted sound pressure level for a sampling period of 297 minutes. A zero increment was used for the 183 minutes not sampled. The employer did not administer a hearing conservation program.

29 CFR  1910.133(a)(2): The employer did not ensure that each affected employee used eye protection that provided side protection when there was a hazard from flying objects.   a.) Casters Sawmill Inc, 6323 U.S. 11, Sandy Creek, NY, 13145 on or about 3/5/2025; Employees were exposed to hazards from flying objects while operating the sawmill, chop saw, edger, and pneumatic nail gun, and the employer did not ensure that employees had eye protection that provided side protection.  Abatement certification is required.
