Hazards not otherwise classified and hazards identified and classified under (d)(1)(ii) do not have to be addressed on the container. Where the chemical manufacturer, importer, or distributor is required to label, tag or mark, the signal word shall be provided. a) On or about and at times prior to March 6, 2025, at the establishment located at N7418 Wisconsin 42, Sheboygan, Wisconsin; the employer did not ensure that each container of Fortress No Odor Final B displayed the correct signal word, exposing employees to chemical hazards. The safety data sheet for the chemical indicated that the signal word was "danger" and the label on the chemical container displayed the signal word as "warning."

Construction Reference: 29 CFR 1926.103 Note: The requirements applicable to construction work under this section are identical to those set forth at 29 CFR 1910.134 of this chapter. 29 CFR 1910.134(c)(2)(ii): The employer must establish and implement those elements of a written respiratory protection program necessary to ensure that any employee using a respirator voluntarily is medically able to use that respirator, and that the respirator is cleaned, stored, and maintained so that its use does not present a health hazard to the user. Exception: Employers are not required to include in a written respiratory protection program those employees whose only use of respirators involves the voluntary use of filtering facepieces (dust masks). a) On or about and at times prior to March 24, 2025, at the establishment located at N7418 Wisconsin 42, Sheboygan, Wisconsin; the employer did not establish and implement a written respiratory protection program for employees provided with voluntary use respirators. 29 CFR 1926.1153(g)(1): The employer shall establish and implement a written exposure control plan that contains at least the following elements: (i) A description of the tasks in the workplace that involve exposure to respirable crystalline silica; (ii) A description of the engineering controls, work practices, and respiratory protection used to limit employee exposure to respirable crystalline silica for each task; (iii) A description of the housekeeping measures used to limit employee exposure to respirable crystalline silica; and (iv) A description of the procedures used to restrict access to work areas, when necessary, to minimize the number of employees exposed to respirable crystalline silica and their level of exposure, including exposures generated by other employers or sole proprietors. a) On or about and at times prior to March 24, 205, at various worksites in Wisconsin; the employer did not establish and implement a written silica exposure control plan for when employees grind concrete containing crystalline silica with walk-behind floor grinders and handheld grinders, exposing employees to the hazards associated with respirable crystalline silica.
