29 CFR  1926.501(b)(10):Each employee engaged in roofing activities on low-slope roofs with unprotected sides and edges 6 feet or more above lower levels, was not protected from falling by guardrail systems, safety net systems, personal fall arrest systems, or a combination of warning line system and guardrail system, warning line system and safety net system, or warning line system and personal fall arrest system, or warning line system and safety monitoring system.  Or, on roofs 50-feet (15.25 m) or less in width, each employee was not protected by use of a monitoring system.  On or about March 12, 2025, on the front side of the building, employees were performing roofing activities on a flat roof with no warning flags or any other fall protection in place.  The Mario Bernal was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(10), which was contained in OSHA inspection number 1566385, citation number 1, item number 2 and was affirmed as a final order on 03/17/2022, with respect to a workplace located at 7210 San Pedro Ave., San Antonio, TX 78216.

29 CFR  1926.503(a)(1):The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards:  On or about March 12, 2025, on the front side of the building, employees were working on an elevated surface greater than 6 feet without being provided effective training in the recognition of fall hazards.  The Mario Bernal was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.503(a)(1), which was contained in OSHA inspection number 1566385, citation number 1, item number 4, and was affirmed as a final order on 03/17/2022, with respect to a workplace located at 7210 San Pedro Ave., San Antonio, TX 78216.
