29 CFR  1926.1052(c)(12): Unprotected sides and edges of stairway landings were not provided with guardrail systems that meet the criteria contained in Subpart M of 29 CFR 1926:   a) Building 4, Second Floor: On or about March 18, 2025, the employer exposed employees to a fall hazard, in that there were no guardrails at the second floor breezeway, with a fall to ground distance of 11'8", for employees that used the stairs.

(a) Building 4: On or about March 18, 2025 the employer exposed employees to a health hazard, in that information contained in Appendix D was not provided to employees who used elastomeric, negative pressure respirators on a voluntary basis while sanding.

29 CFR  1910.134(c)(2)(ii): The employer did not establish and implement those elements of a written program necessary to ensure that any employee using a respirator voluntarily was medically able to use that respirator, and that the respirator was cleaned, stored, and maintained so that its use does not present a health hazard to the user: (Construction Reference 196.103).  (a) Building 4: On or about March 18, 2025, the employer exposed employees to a health hazard, in that employees were not evaluated medically prior to voluntary use of elastomeric, negative pressure respirators and the employer did not ensure the respirators were cleaned and stored properly.
