29 CFR 1926.451(b)(3):The front edge of all platforms was not 14 inches (36 cm) or less from the face of the work, and no guardrail systems were erected along the front edge and/or no personal fall arrest systems were used in accordance with paragraph (g) of this section to protect employees from falling.   On or about March 18, 2025, it was observed that employees performing grouting and sealing on a residential construction site located at 3335 South 307th Street, Elkhorn, Nebraska were exposed to fall hazards in that employees worked from a scaffold approximately 6 feet, 6 inches above the next lower level where the gap between scaffold front edge and the working surface was measured at approximately 23 inches.

29 CFR 1926.451(c)(2): Supported scaffold poles, legs, posts, frames, or uprights did not bear on base plates and mud sills or other adequate firm foundation:  On or about March 18, 2025, it was observed that employees performing grouting and sealing on a residential construction site located at 3335 South 307th Street, Elkhorn, Nebraska were exposed to fall hazards in that employees worked from scaffolds greater than 6 feet above the next lower level where all the scaffold poles did not bear on base plates and mud sills and were erected on uneven terrain.   Instances of inadequate scaffold support included but was not limited to:  i.	i. Safway tubular welded frame scaffold #1 approximately 6 feet, 5 inches from the ground where not all scaffold poles bore on mud sills and at least one mud sill created an unstable foundation, and   ii.	Tubular welded frame scaffold #3 approximately 6 feet, 8 inches from the ground where the poles did not bear on base plates.

1926.21(b)(2):  The employer did not instruct each employee in the recognition and avoidance of unsafe condition(s) and the regulation(s) applicable to his work environment to control or eliminate any hazard(s) or other exposure to illness or injury:   On or about March 18, 2025, it was observed that employees performing grouting and sealing on a residential construction site located at 3335 South 307th Street, Elkhorn, Nebraska were exposed to fall hazards in that the employer failed to ensure employees working on a residential construction site were trained in the recognition of hazards associated with the work being conducted.
