29 CFR 1926.451(c)Criteria for supported scaffolds.(2)(v): Fork-lifts shall not be used to support scaffold platforms unless the entire platform is attached to the fork and the fork-lift is not moved horizontally while the platform is occupied. a) On March 18, 2025, the employer failed to ensure that a scaffold platform used on the forks of a telehandler was properly attached. Specifically, four employees accessed a commercial roof by standing on an unsecured pallet placed on the forks of a telehandler to perform concrete work. The pallet was not attached to the forks, and the equipment was used to elevate employees without meeting the requirements for supported scaffold platforms. As a result, employees were exposed to a fall hazard of approximately 26 feet.

29 CFR 1926.602(d):Powered industrial truck operator training. Note: The requirements applicable to construction work under this paragraph are identical to those set forth at ��1910.178(l) of this chapter. 1910.178(l)(2)(ii) Training shall consist of a combination of formal instruction (e.g., lecture, discussion, interactive computer learning, video tape, written material), practical training (demonstrations performed by the trainer and practical exercises performed by the trainee), and evaluation of the operator's performance in the workplace. a) On or about March 18, 2025, the employer failed to ensure that employees received training that included practical instruction and performance evaluation in the safe operation of powered industrial trucks. As a result, the untrained operator raised and lowered the telehandler's forks while employees were riding on an unsecured pallet to access a commercial roof. The employees were exposed to a fall hazard of approximately 26 feet.

(2)(iv): Front-end loaders and similar pieces of equipment shall not be used to support scaffold platforms unless they have been specifically designed by the manufacturer for such use. a) On March 18, 2025, the employer did not ensure that employees were protected from falls up to approximately 26 feet while standing on an unsecured pallet that was raised and lowered by the operator of a Genie GTH-636 telehandler.
