OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that they were exposed to the hazard of being struck-by a rolling vehicle while loading a vehicle onto the flatbed tow truck:  a) Worksite, Decker & Toleman Rd. Washingtonville, NY: On or about March 18, 2025 an employee was loading a passenger vehicle onto a tow truck equipped with Century Series 10 Gen II tow bed when the tow winch failed causing the vehicle to roll backwards striking the employee and running him over.
