29 CFR 1926.651(c)(2): A stairway, ladder, ramp or other safe means of egress was not located in trench excavations that were 4 feet (1.22m) or more in depth so as to require no more than 25 feet (7.62m) of lateral travel for employees: (a) On March 21, 2025, employees were exposed to cave-in and engulfment hazards while working inside a trench measuring approximately 21 feet deep, 23 feet wide at the top, 15 feet at the bottom, and 29 feet long. Employees were not provided a means of egress and entered and exited the excavation via the north end wall which was nearly vertical and measured approximately 9 feet high.

29 CFR 1926.651(k)(2): Where the competent person found evidence of a situation that could result in a possible cave-in, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions, exposed employees were not removed from the hazardous area until the necessary precautions have been taken to ensure their safety. (a) On March 21, 2025, employees were exposed to cave-in and engulfment hazards while working outside of a trench box in an excavation with Type B soil and nearly vertical walls. The excavation measured at least 21 feet deep, 23 feet wide at the top, 15 feet wide at the bottom, and 29 feet long. A partial cave-in had happened earlier in the day, ground water was present, and fissuring was visible.

29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed: (a) On March 21, 2025, employees were exposed to a fall hazard of approximately 12 feet while using a portable extension ladder to exit the lower section of an excavation. The ladder side rails rested against the wall of the deeper excavation, approximately 2 feet below the landing surface.
