29 CFR 1926.28(a): The employer did not require the wearing of appropriate personal protective equipment in all operations where there is an exposure to hazardous conditions. a) On or about March 21, 2025 and at times prior, at SW 87 Avenue Palmetto Bay FL 33157, the employer did not ensure employees, who were working near a 4-foot-deep excavation that was filled with water, wore a personal flotation device.

29 CFR 1926.651(h)(1):Employees were working in excavations in which there was accumulated water, or excavations in which water was accumulating, and adequate precautions had not been taken to protect employees against the hazards posed by water accumulation. a) On or about March 21, 2025 and at times prior, at SW 87 Avenue Palmetto Bay FL 33157, employees were exposed to drowning and cave-in hazards while working inside a trench that was filled with 4 feet of water without the employer utilizing a water pump to eliminate the water and prevent the water from accumulating.

29 CFR 1926.651(h)(3): Where excavation work interrupted the natural drainage of surface water (such as streams), diversion ditches, dikes, or other suitable means were not used to prevent surface water from entering the excavation and to provide adequate drainage of the area adjacent to the excavation: a) On or about March 21, 2025, and at times prior, at SW 87 Avenue Palmetto Bay FL 33157, employees were exposed to slip and fall and drowning hazards while working near and inside a 4-foot, 6-inch-deep trench with 4 feet of water accumulation. The employer did not implement a suitable means to prevent surface water from entering the excavation and adequate drainage of the area adjacent to the excavation.
