29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent: On or about April 16, 2025, in the cross cut saw and plastic shredding areas where employees were exposed to noise at eight hour time weighted averages between 98.9 and 91.1 decibels before an effective hearing conservation program had been implemented.

In the crosscut saw area where employees were using a crosscut saw identified by the employer as Line #5 without a properly adjusted guard to protect employees from the cutting blade. b. In the crosscut saw area where employees were using a crosscut saw identified by the employer as Line #8 without a properly adjusted guard to protect employees from the cutting blade. c. In the crosscut saw area where employees were using a crosscut saw identified by the employer as Line #11 without a properly adjusted guard to protect employees from the cutting blade. d. In the crosscut saw area where employees were using a crosscut saw identified by the employer as Line #13 without a properly adjusted guard to protect employees from the cutting blade. e. In the crosscut saw area where employees were using a Rexon brand 13 inch drill press without a point of operation guard.

29 CFR 1910.215(a)(4): On offhand grinding machines, work rests were not used to support the work and/or were not kept adjusted closely to the wheel with a maximum opening of one-eighth inch to prevent the work from being jammed between the wheel and the rest, which may cause wheel breakage: On or about April 10, 2025, in maintenance area where employees were using a Dayton brand bench grinder without the work rest adjusted to the wheel with a maximum opening of one-eighth inch.

29CFR 1904.41(a)(1)(i): If your establishment had 20-249 employees at any time during the previous calendar year, and your establishment is classified in an industry listed in appendix A to subpart E of this part, then you must electronically submit information from OSHA Form 300A Summary of Work-Related Injuries and Illnesses to OSHA or OSHA's designee. You must submit the information once a year, no later than the date listed in paragraph (c) of this section of the year after the calendar year covered by the form. On or about April 9, 2025 the employer had not electronically submitted information from the OSHA Form 300A for calendar year 2024 to OSHA. The information was submitted on April 10th, 2025 when it was required to be submitted by March 2, 2025
