29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net system, or personal fall arrest system, nor was an alternative fall protection measure provided:  a- 2nd Floor - North Facing - 300 Boulevard, Seaside Heights NJ: A worker prepping a residential structure's second floor balcony flooring for a fiberglass coating, and performing other related activities while working and walking near and at its unprotected edges without fall protection, fell from the balcony landing on the ground below. Condition noted on or about 04/10/25.  b - Roof - 300 Boulevard, Seaside Heights NJ: Workers and the company worksite Foreman were exposed to fall hazards when working and walking at and near the unprotected edges of a residential structure's roof without fall protection. Condition noted on or about 04/16/25 & 04/14/25.  c- 3rd Floor - North & South Facing - 300 Boulevard, Seaside Heights NJ: Workers and the company worksite Foreman were exposed to fall hazards when working and walking at and near the unprotected edges of a residential structure's 3rd floor balconies without fall protection.  Condition noted or or about 04/16/25 & 04/14/25.   d- 2nd Floor - North & South Facing - 300 Boulevard, Seaside Heights NJ: Workers were exposed to fall hazards when working and walking at and near the unprotected edges of a residential structure's 2nd floor balconies without fall protection.  Condition noted or or about 04/16/25 & 04/14/25.  NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM.  FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR  1926.503(a)(2): The employer did not assure that each employee exposed to fall hazards was trained by a competent person qualified in the areas specified in 29 CFR 1926.503 (a)(2)(i) through (viii)   a - 300 Boulevard, Seaside Heights NJ:   The company worksite Foreman and their worksite workers were exposed to fall hazards, up to an in excess of 25 feet to the ground surface below, while working and walking from a residential structure's roof, 3rd  & 2nd floor balconies each having unprotected edges, and without fall protection. The worksite Foreman and their worksite workers had not received fall protection training as specified in 29 CFR 1926.503 (a)(2)(i) through (viii).   Condition noted on or about and prior to 04/10/25.    NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM.  FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
