OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees   a) Jobsite located at or near North 11th Street and West Girard Ave, Philadelphia, PA - On or about April 16, 2025, the employer did not ensure the work area was posted with legible traffic signs at points of hazards.  Employees were performing tree removal without traffic signs thereby exposing employees to struck-by hazards.  Among other methods, feasible and acceptable means of hazard abatement include but are not limited to:  1. Follow American National Standards Institute (ANSI) Z133-2017 for Arboricultural Operations-Safety Requirements in Section 3.5 and the Manual on Uniform Traffic Control Devices (MUTCD) 2009 edition. a. Develop a tree removal work plan and identify job task assignments that includes traffic and pedestrian control around the worksite prior to the start of arboricultural operations. b. Have arborists and other workers be trained in temporary traffic control techniques, device usage and placement, and how to work next to traffic in a manner that minimizes their exposure.

29 CFR OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by hazards:  a) Jobsite located at or near North 11th Street and West Girard Ave, Philadelphia, PA - On or about April 16, 2025, a qualified arborist did not perform a job briefing before the start of each job, including determining possible hazards. Employees were engaged with tree removal activities without a job briefing being conducted, exposing employees to struck-by hazards.    Among other methods, feasible and acceptable means of hazard abatement include but are not limited to:  1. Follow American National Standards Institute (ANSI) Z133-2017 for Arboricultural Operations-Safety Requirements in Section 3. a. Ensure a qualified arborist conducts a hazard assessment of the worksite to identify at a minimum the types of trees involved, possible hazards related to the structure, indicators of decay, weakly attached branches, and if the tree can withstand the forces to be applied during work.  b. Develop a tree removal work plan and identify job task assignments. The qualified arborist should then perform a job briefing before the start of the job. c. Determine what specific personal protective equipment is required and establish a drop zone.

29 CFR  1910.67(c)(2)(v): A personal fall arrest or travel restraint system that meets the requirements in subpart I of this part was not worn and attached to the boom or basket when working from an aerial lift:  a) Jobsite located at or near North 11th Street and West Girard Ave, Philadelphia, PA - On or about April 16, 2025, the employer did not ensure employees working in the bucket of the ariel lift performing tree removal activities wore a personal fall arrest or travel restraint system that meets the requirements, thereby exposing employees to fall hazards.
