29 CFR  1910.134(c)(1):In any workplace where respirators are necessary to protect the health of the employee or whenever respirators are required by the employer, the employer shall establish and implement a written respiratory protection program with worksite-specific procedures. The program shall be updated as necessary to reflect those changes in workplace conditions that affect respirator use. The employer shall include in the program the following provisions of this section, as applicable:  a) On or about May 27, 2025, the employer did not establish a written respiratory protection program for employees required to wear 3M tight-fitting half face respirators while performing sanding on cars.

29 CFR  1910.134(e)(6)(i): Medical determination. In determining the employee's ability to use a respirator, the employer shall: Obtain a written recommendation regarding the employee's ability to use the respirator from the PLHCP. The recommendation shall provide only the following information:  (A) Any limitations on respirator use related to the medical condition of the employee, or relating to the workplace conditions in which the respirator will be used, including whether or not the employee is medically able to use the respirator; (B) The need, if any, for follow-up medical evaluations; and (C) A statement that the PLHCP has provided the employee with a copy of the PLHCP's written recommendation.  a) On or about May 27, 2025, the employer did not have written recommendations for respirator use for employees required to wear 3M half-face tight fitting respirators while welding on cars.

29 CFR  1910.134(f)(2):The employer shall ensure that an employee using a tight-fitting facepiece respirator is fit tested prior to initial use of the respirator, whenever a different respirator facepiece (size, style, model or make) is used, and at least annually thereafter.  a) On or about May 27, 2025, the employer did not ensure employees required to wear 3M half-face tight fitting respirators were fit tested before being permitted to weld on cars.

29 CFR  1910.134(m)(2)(i): The employer shall establish a record of the qualitative and quantitative fit tests administered to an employee including:  (A) The name or identification of the employee tested; (B) Type of fit test performed; (C) Specific make, model, style, and size of respirator tested; (D) Date of test; and (E) The pass/fail results for QLFTs or the fit factor and strip chart recording or other recording of the test results for QNFTs.  a) On or about May 27, 2025, the employer did not ensure that records of fit testing for all employees were maintained that included the type of fit test performed.

29 CFR  1910.1200(e)(1):Employers shall develop, implement, and maintain at each workplace, a written hazard communication program which at least describes how the criteria specified in paragraphs (f), (g), and (h) of this section for labels and other forms of warning, safety data sheets, and employee information and training will be met, and which also includes the following:  a) On or about May 27, 2025, the employer did not develop a written hazard communication program for employees exposed to chemicals such as, but not limited to, PPG ECP35 Envirobase primer (eye, skin, respiratory irritation).
