OSH ACT of 1970 Section (5)(a)(1):The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck by and crushing hazards when removing a tree: a) Jobsite: On or about April 25, 2025, employees where exposed to struck by and crushing hazards during tree removal when using a chain saw above shoulder height to make cuts on an approximate 60 foot tree that was leaning at an approximate 45 degree angle and the employer did not have develop a tree removal work plan that was communicated to the crew including the proper use of equipment, employee positions and use of the path for egress, and the hazard of barber chair for trees under tension.
