29 CFR 1926.453(b)(2)(v): A safety harness was not worn and/or a lanyard was not attached to the boom or basket when working from an aerial lift:   (a)David Nelson Construction, LLC at 1825 East 77th Circle, Sioux Falls, SD 57108: On or about and at times prior to April 25, 2025, the employer did not ensure that employees were protected from falls by an adequate fall protection system while conducting framing activities while working from a JLG aerial lift platform, model number 860SJ, serial number 0300114033, located on the north exterior wall of a multi-family residential building.  This condition exposed the employees to fall and ejection hazards greater than 10 feet.

29 CFR 1926.453(b)(2)(iv): Employees working in an aerial lift were sitting or climbing on the edge of the basket:  (a)David Nelson Construction, LLC at 1825 East 77th Circle, Sioux Falls, SD 57108: On or about and at times prior to April 25, 2025, the employer did not ensure that employees were protected from falls while conducting framing activities in that employees were climbing and standing on the railings of an aerial lift platform located on the north wall of a multi-family residential building.  This condition exposed the employees to fall hazards greater than 10 feet.

This condition exposed the employees to fall hazards greater than six feet.
