29 CFR  1926.501(b)(1): Employees on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level were not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems:  (a)TMS Companies, at I90 and Highway 11, Brandon, SD 57005: On or about and at times prior to April 25, 2025, the exposing employer did not ensure that employees were protected from fall hazards while erecting a retaining wall greater than 19 feet above the roadway below.   This condition exposed employees to fall hazards greater than six feet.

29 CFR  1926.503(b)(1):The employer did not verify compliance with paragraph (a) of this section by preparing a written (training) certification record to include the name or other identity of the employees trained in fall protection, the date(s) of the training, and the signature of the person who conducted the training or the signature of the employer which exposed employees:  (a)TMS Companies, at I90 and Hwy 11, Brandon, SD 57005: On or about and at times prior to April 25, 2025, the exposing employer did not ensure that employees were properly trained and documented on the hazards of falls or how to identify hazards prior to being exposed while conducting retaining wall installation. This condition exposed the employee to fall hazards greater than six feet.
