29 CFR 1910.95(g)(1): The employer did not establish and maintain an audiometric testing program as provided by 29 CFR 1910.95(g) by making audiometric testing available to all employees whose exposures equal or exceed an 8-hour time-weighted average of 85 decibels: On or about April 30, 2025, the employer had not established and implemented an audiometric testing program for employees exposed to noise levels which exceed the action level of a dose of 50 percent. Employees working on the grind and shred line were exposed to noise levels at 94.6% (89.6dB) to 131% (91.9 dB) of the permissible daily dose as measured over 336 minutes to 452 minutes of sampling.
