29 CFR 1926.28(a): The employer did not require the wearing of appropriate personal protective equipment in all operations where there is an exposure to hazardous conditions:  a) 6 Baldwin Place, Building A - On or about April 30, 2025 and at times prior thereto, an employee was operating a 2019 Komatsu PC290LC-11 excavator setting deadman blocks into an excavation and backfilling the excavation when the excavator slid down an embankment and rolled onto its side. The employee was not wearing the seat belt within the cab and was exposed to struck-by and crush-by hazards.

29 CFR  1926.602(a)(3)(i): The employer moved construction equipment upon a grade that was not constructed and maintained to accommodate safely the movement of the equipment involved:  a) 6 Baldwin Place, Building A - On or about April 30, 2025 and at times prior thereto, an employee was operating a 2019 Komatsu PC290LC-11 excavator setting deadman blocks into an excavation and backfilling the excavation on a slope when the ground gave way causing the excavator to slide down the embankment and roll onto its side exposing him to struck-by and crush-by hazards.
