29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent:  On or about May 7, 2025, the employer did not implement a continuing, effective hearing conservation program which includes noise monitoring, employee notification, audiometric testing, training, information, and recordkeeping.   a) An employee operating the tear-down saw was exposed to noise at an 8-hour time weighted average of 95.3 dBA, as measured over 437 minutes of sampling.  b) An employee operating the pneumatic nail and staple guns  was exposed to noise at an 8-hour time weighted average of 95 dBA, as measured over 458 minutes of sampling.  c) An employee operating the Whirlwind saw was exposed to noise at an 8-hour time weighted average of 100.3 dBA, as measured over 387 minutes of sampling.  d) An employee operating the chop saw was exposed to noise at an 8-hour time weighted average of 93.9 dBA, as measured over 231 minutes of sampling.
