29 CFR 1910.243(e)(1)(ii):All power-driven chains, belts, and gears shall be so positioned or otherwise guarded to prevent the operator's accidental contact therewith, during normal starting, mounting, and operation of the machine. On or about May 13, 2025, the employer did not ensure the power-driven deck drive belt of the Hustler Hyperdrive Zero-Turn Riding Rotary Lawn Mowers, known to the employer as lawn mower 2B and 3B, was guarded or covered to prevent the operator from accident contact during starting and/or operation of the lawn mowers.

29 CFR 1910.243(e)(4)(iii):There shall be one of the following at all openings in the blade enclosure intended for the discharge of grass: [1910.243(e)(4)(iii)(a) A minimum unobstructed horizontal distance of 6 inches from the end of the discharge chute to the blade tip circle]. [1910.243(e)(4)(iii)(b) A rigid bar fastened across the discharge opening, secured to prevent removal without the use of tools. The bottom of the bar shall be no higher than the bottom edge of the blade enclosure]. On or about May 1, 2025, the employer did not ensure the blade deck grass discharge opening of the Hustler Hyperdrive Zero-Turn Riding Rotary Lawn Mowers, known to the employer as mower 2B and 3B, were equipped with a chute or cover that extended at least 6 inches from the end of the discharge opening to the blade tip [per 1910.243(e)(4)(iii)(a)] or a rigid bar fastened across the discharge opening no higher than the bottom edge of the blade deck enclosure [per 1910.243(e)(4)(iii)(b)].

29 CFR 1904.39(a)(2):Basic Requirement. Within twenty-four (24) hours after the in-patient hospitalization of one or more employees or an employee's amputation or an employee's loss of an eye, as a result of a work-related incident, you must report the in-patient hospitalization, amputation, or loss of an eye to OSHA. On or about May 2, 2025, the employer did not report within 24 hours an in-patient hospitalization injury of an employee who received laceration injuries to his left leg while operating a zero-turn riding lawn mower at an employer's worksite on May 1, 2025. The employer was notified the injury resulted in an in-patient hospitalization on or about May 1, 2025. OSHA was not notified of the in-patient hospitalization injury until a formal complaint was filed approximately on or about May 8, 2025, via the OSHA online complaint form webpage.
