At the lowest landing, the sides not used for exit or entrance to the structure were not enclosed to a height of at least 10 feet.  a) Work site at 10 Commerce Ct., Newark, NJ: Employer did not ensure that the sides used for entrance and exit to the structure on all the floors were provided with adequate enclosures, on or about 05/10/2025.   b) Work site at 10 Commerce Ct., Newark, NJ: Employer did not ensure that the sides not used for entrance and exit to the hoist at ground level had enclosures measuring at least 10 feet, on or about 05/10/2025.

29 CFR  1926.20(b)(2): The employer did not initiate and maintain programs which provided for frequent and regular inspections of the job site, materials and equipment to be made by a competent person(s)   a) Work site at 10 Commerce Ct., Newark, NJ:  Hoist towers outside the structure were not enclosed for the full height on the side or sides used for entrance and exit to the structure. The employer did not provide frequent and regular inspections by a competent person of the jobsite to ensure that employees were not exposed to hazards from equipment and materials, on or about 05/10/2025.   b) Work site at 10 Commerce Ct., Newark, NJ: At the lowest landing, the sides of the hoist tower not used for exit or entrance to the structure were not enclosed to a height of at least 10 feet. The employer did not provide frequent and regular inspections by a competent person of the jobsite  to ensure that employees were not exposed to hazards from equipment and materials made by competent persons, on or about 05/10/2025.

29 CFR  1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury:   a) Work site at 10 Commerce Ct., Newark, NJ:  Hoist towers outside the structure were not enclosed for the full height on the side or sides used for entrance and exit to the structure. The employer did not instruct the employees in the recognition of hazards associated with the fact that the sides used for entrance and exit to the structure on all the floors were not provided with adequate enclosures. The employer did not instruct employees on the regulations applicable to installation of the adequate enclosures, on or about 05/10/2025.  b) Work site at 10 Commerce Ct., Newark, NJ: At the lowest landing, the sides of the hoist tower not used for exit or entrance to the structure were not enclosed to a height of at least 10 feet. The employer did not instruct the employees in the recognition of hazards associated with the fact that the sides not used for entrance and exit to the hoist at ground level did not have proper enclosures, on or about 05/10/2025.
