29 CFR 1926.451(f)(3):Scaffolds and scaffold components shall be inspected for visible defects by a competent person before each work shift, and after any occurrence which could affect a scaffold's structural integrity. a) On or about May 21, 2025, the employer did not conduct adequate inspections of the ladder jack scaffold. Employees were exposed to fall heights greater than 12 ft in that no means of conventional fall protection was being used, a folded up A-frame ladder was being used to support one side of the scaffold and the platforms of the 3 ladder jack scaffolds were bridged across each other.

29 CFR 1926.451(g)(1):Each employee on a scaffold more than 10 feet (3.1 m) above a lower level shall be protected from falling to that lower level. Paragraphs (g)(1)(i) through (vii) of this section establish the types of fall protection to be provided to the employees on each type of scaffold. Paragraph (g)(2) of this section addresses fall protection for scaffold erectors and dismantlers. Note to paragraph (g)(1): The fall protection requirements for employees installing suspension scaffold support systems on floors, roofs, and other elevated surfaces are set forth in subpart M of this part. a) On or about May 21, 2025, employees are exposed to a fall hazard greater than 12 ft while performing siding work on a residential jobsite on a ladder jack scaffold without utilizing a personal fall arrest system or guardrail system.

Scaffold platforms shall not be bridged one to another. a) On or about May 21, 2025, the employer did not ensure ladder jack scaffold platforms were not bridged together in that employees were exposed to a fall hazard while performing siding work on 3 bridged together ladder jack scaffolds that created a U-shape on a residential jobsite.

29 CFR 1926.454(a):The employer shall have each employee who performs work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards. The training shall include the following areas, as applicable: (1) The nature of any electrical hazards, fall hazards and falling object hazards in the work area; (2) The correct procedures for dealing with electrical hazards and for erecting, maintaining, and disassembling the fall protection systems and falling object protection systems being used; (3) The proper use of the scaffold, and the proper handling of materials on the scaffold; (4) The maximum intended load and the load-carrying capacities of the scaffolds used; and (5) Any other pertinent requirements of this subpart a) On or about May 21, 2025, the employer failed to ensure that employees performing siding work on a ladder jack scaffold were trained by a qualified person to recognize and minimize hazards. Specifically, employees were not trained on the need for proper means of setting up a scaffold, ladder jack platforms cannot be bridged, and the requirement for fall protection systems. As a result, employees were exposed to fall hazards greater than 12 ft.

29 CFR 1926.501(b)(13):"Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502. Note: There is a presumption that it is feasible and will not create a greater hazard to implement at least one of the above-listed fall protection systems. Accordingly, the employer has the burden of establishing that it is appropriate to implement a fall protection plan which complies with 1926.502(k) for a particular workplace situation, in lieu of implementing any of those systems. a) On or before May 21, 2025, the employer failed to ensure that employees performing siding from a porch roof of a residential home were utilizing a fall protection system. Employees were exposed to fall heights greater than 9 ft.

29 CFR 1926.1053(b)(1):When portable ladders are used for access to an upper landing surface, the ladder side rails shall extend at least 3 feet (.9 m) above the upper landing surface to which the ladder is used to gain access; or, when such an extension is not possible because of the ladder's length, then the ladder shall be secured at its top to a rigid support that will not deflect, and a grasping device, such as a grabrail, shall be provided to assist employees in mounting and dismounting the ladder. In no case shall the extension be such that ladder deflection under a load would, by itself, cause the ladder to slip off its support. a) On or about May 21, 2025, the employer did not ensure that employees exposed to a fall hazard were protected in that the portable ladder used for accessing the porch roof only extended 1.5 ft above the upper landing surface.
