29 CFR  1910.134(c)(1): The employer did not develop and implement a written respiratory protection program with required worksite-specific procedures and elements for required respirator use:   a) At the facility 175 Commerce Drive Suite D Hauppauge NY 11788, on or about May 22nd, 2025 the employer did not develop a respiratory protection program for employees required to use 3M half face elastomeric respirators during the cleaning and emptying of the dust collector on the  Pro-Finish Blasting Cabinet.  Note: The employer is required to submit abatement certification for this item in accordance with 29 CFR 1903.19.

29 CFR  1910.134(e)(1):The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace:  a) At the facility 175 Commerce Drive Suite Hauppauge NY  11788. On or about May 22nd, 2025, the employer did not provide medical evaluations to employees required to use a 3M half face tight fitting elastomeric respirator during cleaning of the dust collector.  Because abatement of this violation is already documented in the case file, the employer need not submit certification or documentation of abatement for this violation as normally required by CFR 1903.19.

29 CFR 1910.134(f)(2): The employer did not ensure that an employee using a tight-fitting respirator is fit tested prior to initial use, whenever a different respirator facepiece (size, style, make or model) is used, and at least annually thereafter.  a) At the facility 175 Commerce Drive Suite D Hauppauge NY 11788, on or about May 22nd 2025 an employee using tight fitting 3M half-face elastomeric respirators when cleaning the dust collection system was not fit tested.  Because abatement of this violation is already documented in the case file, the employer need not submit certification or documentation of abatement for this violation as normally required by CFR 1903.19.
