29 CFR  1910.178(l)(4)(iii): An evaluation of each powered industrial truck operator's performance was not being conducted at least once every three years:  Main Warehouse (Dry and Frozen Goods): On or about May 21, 2025, and at times prior thereto,  employees performance to operate a forklift were not conducted at least once every three years. Employees potentially exposed struck by hazards.  In the alternative.  29 CFR  1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator was competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l):  Main Warehouse (Dry and Frozen Goods): On or about May 21, 2025, and at times prior thereto,  employees were permitted to operate four forklifts had not received training, nor been evaluated in the safe operation of the  fork lifts. Employees potentially exposed struck by hazards.

29 CFR 1910.178(q)(1):  Any power-operated industrial truck not in safe operating condition was not taken out of service, and/or repairs were not made by authorized personnel:  Main Warehouse (Dry and Frozen Goods): On or about May 21, 2025, and at times prior thereto, the employer allowed employees to operate forklift that were not in safe operating condition, the employer potentially exposed employees to bodily harm.
