29 CFR 1926.503(c): The employer did not retrain affected employees who already had been trained but demonstrated inadequate understanding and skill required by paragraph (a) of this section:  464 Westfield St. Holyoke, MA:  On or about May 29, 2025, the employer did not ensure that supervisory employees overseeing subcontractors performing shingle replacement work on a residential rooftop were retrained on the proper use of fall protection. Observed subcontractor employees had not connected their harnesses to the attachment point located on the wearer's back, exposing them to fall hazards of approximately 9 feet.

29CFR 1904.41(a)(1)(i): The establishment had 20 or more employees but fewer than 250 employees at any time during the previous calendar year, and the establishment was classified in an industry listed in appendix A to subpart E of this part, and the employer did not electronically submit information from OSHA Form 300A Summary of Work-Related Injuries and Illnesses to OSHA or OSHA's designee by the specified date:  464 Westfield St., Holyoke, MA: On or about May 29, 2025, the employer had not electronically submitted information from their OSHA Form 300A or equivalent for calendar year 2024 by March 2, 2025. The establishment employed 64 employees during calendar year 2024, and is classified in NAICS Code 238160 which is listed in appendix A to subpart E.
