29 CFR  1910.29(b)(1):Guardrail systems. The employer must ensure guardrail systems meet the following requirements: The top edge height of top rails, or equivalent guardrail system members, are 42 inches (107 cm), plus or minus 3 inches (8 cm), above the walking-working surface. The top edge height may exceed 45 inches (114 cm), provided the guardrail system meets all other criteria of paragraph (b) of this section (see Figure D-11).  a. On or about May 27, 2025, employees were exposed to a fall hazard.  Employees were working on Tank M 17 with the top edge height of the rail less than 42 inches, above the walking working surface.  Abatement certification is required for this item in accordance with the requirements of 29 CFR 1903.13(c).

29 CFR 1910.134(e)(1):The employer did not provide a medical evaluation to determine the employee's ability to use a respirator before the employee was fit tested or required to use the respirator in the workplace:  On or about May 27, 2025, employees were required to wear 3M Half Face respirator 6502 QL series while mixing products caustic soda. The employees were not medically evaluated to determine the employee's ability to use a respirator before the employee is fit tested, or required to use the respirator in the workplace.   Abatement certification is required for this item in accordance with the requirements of 29 CFR 1903.19(c).

29 CFR  1910.132(a):Protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, were not provided, used, and maintained in a sanitary and reliable condition wherever it is necessary by reason of hazards of processes or environment, chemical hazards, radiological hazards, or mechanical irritants encountered in a manner capable of causing injury or impairment in the function of any part of the body through absorption, inhalation or physical contact.  On or about May 13, 2025, employees were exposed to corrosive materials.  Employees were dumping corrosive materials such as Hydrochloric acid into vessels/mixers.  The employer failed to provide protective equipment such as but not limited to chemical resistant clothing, to employees when exposed to corrosive materials.    Abatement certification is required for this item in accordance with the requirements of 29 CFR 1903.19(c).

29 CFR 1910.1200(e)(1):Employers shall develop, implement, and maintain at each workplace, a written hazard communication program which at least describes how the criteria specified in paragraphs (f), (g), and (h) of this section for labels and other forms of warning, safety data sheets, and employee information and training will be met, and which also includes the following:  1. Labels and other forms of warning; 2.List of the hazardous chemicals  3. Methods to inform employees of the hazards on non-routine tasks;   Tank M-17- On or about May 27, 2025, employees dumping bags of raw material into the tank M-17 were exposed to respiratory and chemical hazards specifically corrosive materials, such as but not limited to caustic soda beads.  The employer did not develop, implement, and or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) of this section for labels and other forms of warning, list of hazardous chemicals, and methods to inform employees of the hazards of non-routine tasks.   Abatement documentation is required for this item in accordance with the requirements of 29 CFR 1903.19(d).
