The employer did not ensure that employees using 3M 6503QL half mask elastomeric respirators voluntarily were medically able to use the respirator prior to permitting respirator use.

29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met: At the workplace located at 6704 West 141st St. Overland Park, Kansas, employees engaged in property maintenance activities were exposed to chemical hazards in that a written hazard communication program had not been developed, implemented and maintained at the facility. Employees are handling Kilz Original low odor interior primer, DAP Kwik Seal adhesive caulk, GLB large 3" chlorinating tablets, Airgas dissolved acetylene and Airgas compressed oxygen. The chemical hazards associated with these chemicals include: skin and eye irritation, drowsiness and/or dizziness, burns and/or frostbite, may displace oxygen and cause rapid suffocation, may form explosive mixtures with air, may cause or intensify fire and may explode if heated.
