29 CFR  1926.502(d)(16): Personal fall arrest systems, when stopping a fall, shall be rigged such that an employee can neither free fall more than 6 feet (1.8 m), nor contact any lower level:   a - 7 Charlotte Court, Marlton NJ:   The company worksite Foreman was exposed to fall hazards, in excess of 25 feet to the ground below, while working and walking from the top plates of a residential structure's outer wall while wearing a full body harness whose connected lanyard's other end was draped around a single, upper, unrated, 2 x 4 roof truss chord and connected back to itself by the lanyard's unlatched hook.  Condition observed on or about 06/04/25.  NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM.  FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR  1926.503(a)(2): The employer did not assure that each employee exposed to fall hazards was trained by a competent person qualified in the areas specified in 29 CFR 1926.503 (a)(2)(i) through (viii):   a - 7 Charlotte Court, Marlton NJ:   The company worksite Foreman and a company worker were exposed to falls, in excess of 25 feet, when either improperly utilizing fall protection equipment or when not using fall protection while working and walking from a residential structure's second story, exterior wall top plates when performing roof truss exceptance and installation. The worksite Foreman and their worksite workers had not received fall protection training as specified in 29 CFR 1926.503 (a)(2)(i) through (viii).   Condition noted on or about 06/04/25.  NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM.  FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR  1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):    a - 7 Charlotte Court, Marlton NJ:   A company worker was exposed to fall hazards, in excess of 25 feet to the ground below, while working and walking from the top plates of a residential structure's outer wall while wearing a full body harness whose connected lanyard's other end was not connected to an anchor.  Condition observed on or about 06/04/25.  America First Contractors, LLC. was previously cited for a violation of this occupational safety and health standard or its equivalent standard (1926.501(b)(13)), which was contained in OSHA inspection number 1804110, citation number 2, item number 1 and was affirmed as a final order on April 28, 2025, with respect to a workplace located at Longfield Lane, Blue Bell PA.  America First Contractors, LLC. was previously cited for a violation of this occupational safety and health standard or its equivalent standard (1926.501(b)(13)), which was contained in OSHA inspection number 1720813, citation number 2, item number 1 and was affirmed as a final order on April 15, 2024, with respect to a workplace located at 5 Charlotte Court, Marlton NJ.  America First Contractors, LLC. was previously cited for a violation of this occupational safety and health standard or its equivalent standard (1926.501(b)(13)), which was contained in OSHA inspection number 1702334, citation number 1, item number 1 and was affirmed as a final order on February 7, 2024, with respect to a workplace located at 1 Charlotte Court, Marlton NJ.  America First Contractors, LLC. was previously cited for a violation of this occupational safety and health standard or its equivalent standard (1926.501(b)(13)), which was contained in OSHA inspection number 1643491, citation number 1, item number 1 and was affirmed as a final order on March 24, 2023, with respect to a workplace located at 15 & 17 Nelson's Way, Westampton NJ.  NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM.  FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
