29 CFR 1910.134(e)(1):The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace. The employer may discontinue an employee's medical evaluations when the employee is no longer required to use a respirator. In the body and shop areas, employees engaged in automotive body painting and repair activities were exposed to pulmonary hazards and/or cardiac stress hazards, in that employees required to use 3M tight fitting half-face respirators have not been provided with a medical evaluation prior to use.

29 CFR 1910.134(f)(1): The employer did not ensure that employee(s) required to use a tight-fitting facepiece respirator passed the appropriate qualitative fit test (QLFT) or quantitative fit test (QNFT) In the body and shop areas, employees engaged in automotive body painting and repair activities were exposed to respiratory hazards in that employees required to use 3M tight fitting half-face respirators have not been fit-tested before wearing respirators.

29 CFR 1910.151(c):Where employees were exposed to injurious corrosive materials, suitable facilities for quick drenching or flushing of the eyes and body were not provided within the work area for immediate emergency use: Employees were exposed to chemical hazards when conducting working operations in the shop area. The hazardous chemical being used included but was not limited to Purple Power Concentrated Industrial Strength Cleaner and Degreaser, which is known to cause burns and irritation to eyes and skin. The requirement of having an eyewash station for emergency use was not followed in the main shop area when employees were working with corrosive chemicals.

29 CFR 1910.1200(f)(6):The employer did not ensure that each container of hazardous chemicals in the workplace was labeled, tagged or marked with the information specified under paragraphs (f)(6)(i) through (ii) of this section: Employees were exposed to hazardous chemicals in the body shop in that the chemicals in containers were not labeled. Employees working on vehicles were using chemicals in containers that were not labeled with the type of chemical inside the container, this causes an issue for what precautions were to be taken for personal protective equipment or emergency procedures.
