29 CFR  1910.134(c)(1):The employer did not establish and implement a written respiratory protection program with worksite-specific procedures in any workplace where respirators were necessary to protect the health of the employee or whenever respirators were required by the employer:  a. On or about June 17, 2025 and at times prior, the employer exposed an employee to respiratory hazards, in that an employee was required to wear NIOSH approved, 3M brand half facepiece respirator while grinding on concrete and the employer did not establish and implement a written respiratory protection program that addressed the worksite-specific procedures such as but not limited to employee medical evaluation, fit testing, and training on the use, maintenance and care of the respirator.

On or about June 17, 2025 and at times prior, the employer exposed an employee to respiratory hazards, in that an employee was required to wear NIOSH approved, 3M brand half facepiece respirator, while using a grinder to grind on concrete around pools and customers homes and had not been provided with a medical evaluation prior to wearing the respirator.

On or about June 17, 2025 and at times prior, the employer exposed an employee to respiratory hazards, in that an employee was required to wear a NIOSH approved, 3M brand half facepiece respirator while grinding on concrete and had not been fit tested prior to initial use of the respirator.
