29 CFR  1926.20(b)(2):  Accident prevention responsibilities.  It shall be the responsibility of the employer to initiate and maintain such programs as may be necessary to comply with this part.  Such programs shall provide for frequent and regular inspections of the job sites, materials, and equipment to be made by competent persons designated by the employers.  On or about June 17, 2025, at a worksite located at 200 W College Avenue in Appleton, Wisconsin, the employer did not ensure that frequent and regular inspections of the job site, including material and equipment, had been completed. The employer did not inspect a homemade platform being used as a forklift attachment to ensure it was designed by a qualified person and allowed for personal fall arrest system equipment to be used in accordance with manufacturer's instructions.

29 CFR  1926.451(a)(6):  Scaffolds.  Capacity.  Scaffolds shall be designed by a qualified person and shall be constructed and loaded in accordance with that design.  Non-mandatory Appendix A to this subpart contains examples of criteria that will enable an employer to comply with paragraph (a) of this section.  On or about June 17, 2025, at a worksite located at 200 W College Avenue in Appleton, Wisconsin, the employer did not ensure a qualified person designed a homemade forklift platform prior to employees using it to install exterior wall siding at 14 feet above surface level.  Forklift platform designed did not follow ANSI B56.6A-1994: (a) No slip resistant surface with the use of Oriented Strand Board (b) Floor dimensions exceeded the 10-inch limitation of the ANSI B56.6-1992 Safety Standards for Rough Terrain Forklift Trucks with the platform 122 inches W and telehandler forklift wheelbase 99 inches W. (c) No toe board installed. (f) No maximum working load including personnel and equipment information indicated on the platform.

29 CFR  1926.451(g)(1):  Scaffolds.  Fall Protection.  Each employee on a scaffold more than 10 feet (3.1 m) above a lower level shall be protected from falling to that lower level. Paragraphs (g)(1)(i) through (vii) of this section establish the types of fall protection to be provided to the employees on each type of scaffold.  On or about June 17, 2025, at worksite located at 200 W College Avenue in Appleton, Wisconsin, employees were exposed to a fall hazard while working from a platform elevated by a Skytrak 6036 telehandler at 14 feet above surface level without using required fall protection equipment.

29 CFR  1926.451(g)(3): In addition to meeting the requirements of 1926.502(d), personal fall arrest systems used on scaffolds shall be attached by lanyard to a vertical lifeline, horizontal lifeline, or scaffold structural member.  On or about July 8, 2025, at worksite located at 200 W College Avenue in Appleton, Wisconsin, employees were exposed to a fall hazard while working from a platform elevated by a rough terrain forklift at 21 feet above surface with personal fall arrest systems attached to sling anchors draped over the basket's top guardrail.

29 CFR  1926.454(a)(2): The employer shall have each employee who performs work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards. The training shall include the correct procedures for dealing with electrical hazards and for erecting, maintaining, and disassembling the fall protection systems and falling object protection systems being used.  On or about June 17, 2025, at worksite located at 200 W College Avenue in Appleton, Wisconsin, employees performing exterior wall siding installation were not trained in the recommended use and installation of personal fall arrest system equipment with forklift work platforms while being exposed to fall hazards of 21 feet.

29 CFR  1926.502(d)(16)(iii):  Personal fall arrest systems.  Personal fall arrest systems, when stopping a fall shall be rigged such that an employee can neither free fall more than 6 feet (1.8 m), nor contact any lower level.  On or about July 8, 2025, at worksite located at 200 W College Avenue in Appleton, Wisconsin, employees were exposed to a fall hazard while working from a platform elevated by a rough terrain forklift 21 feet above surface level using personal fall arrest systems that were not installed following the manufacturer's recommendations.  The anchor point not secured and SRL anchored below the body harness dorsal D-ring which would have allowed the employees to free fall more than 6 feet.
