Employees were required to perform these operations without the benefit of a fall protection system.  This condition exposed employees to fall hazards.

29 CFR  1926.1053(b)(6): Unsecured ladder(s) were used on surfaces that were not stable and level:   a)  On or about June 24, 2025, the exposing employer, Toro Construction, Inc., did not ensure an unsecured, portable ladder was used on a stable and level surface.  When engaged in residential re-roofing operations on a two-story home, employees were required to use the portable, Little Giant Leveler ladder when the ladder legs were placed on either side of the roof ridge on the first story.  Employees used the ladder to access the second story.  This condition exposed employees to fall hazards.
