29 CFR 1926.102(a)(1): The employer did not ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation: a) Lot #157: On 06/25/2025, the employer exposed employees to struck-by hazards while operating and pneumatic nail guns, in that protective eyewear was not provided while operating these tools at 225 PSI. b) Lot #157: On 06/25/2025, the employer exposed employees to struck-by hazards while operating circular saws, in that protective eyewear was not provided while operating these tools.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501(b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502: a) Lot #157, Roof: On 6/25/2025, the employer exposed employees to fall hazards of approximately 19-feet, 10-inches from the lower ground level, in that a fall protection system was not provided to employees while installing plywood sheathing to construct the roof. b) Lot #157, Second Floor: On 6/25/2025, the employer exposed employees to fall hazards of approximately 12-feet, 7-inches from the lower ground level, in that a fall protection system while working near a rough opening engaged in framing activities.
