29 CFR 1926.55(a)(2): An employee(s) was exposed to substance(s) with a permissible exposure limit not preceded by (C) at concentrations above that specified in Table 1 of §1926.55 for that substance(s): a) On or about June 27, 2025, employees performing concrete cutting work inside an enclosed room within a commercial building were exposed to carbon monoxide produced from operating a gas-powered Husqvarna K770 Demo Saw and a gas-powered Husqvarna FS400 LV stand behind saw. One employee had a carbon monoxide intoxication in the setting of atherosclerotic cardiovascular disease, resulting in a workplace fatality. Based on the blood carboxyhemoglobin (COHb) levels, OSHA has determined that the employee's exposure exceeded the Permissible Exposure Level (PEL) for carbon monoxide. Employee "A" was exposed to carbon monoxide (CO) during a 120-minute occupational exposure at a mean calculated 335.2 ppm CO level (SAE = 0.122). The %COHb in the employees' blood reached a calculated peak level of 25.0%. Atmospheric pressure, height, weight, activity levels, tobacco smoking behavior, and other factors were taken into account. The 8-hour TWA exposure was 83.8 ppm CO (SAE = 0.106),which is 1.68 times the OSHA PEL of 50 ppm CO.

29 CFR 1926.55(b): Feasible administrative or engineering controls were not implemented to reduce employee exposure(s) to a substance(s) listed in Table 1 or 2 of §1926.55: a.) On or about June 27, 2025, employees performing concrete cutting work inside of an enclosed, commercial building were exposed to carbon monoxide produced from operating a gas-powered Husqvarna K770 Demo Saw and a gas-powered Husqvarna FS400 LV stand behind saw. The employer failed to utilize feasible engineering controls such as but not limited to force air ventilation to reduce employee exposures(s) to carbon monoxide. One employee had a carbon monoxide intoxication in the setting of atherosclerotic cardiovascular disease, resulting in a workplace fatality. Based on the blood carboxyhemoglobin (COHb) levels, OSHA has determined that their exposure exceeded the Permissible Exposure Level (PEL) for carbon monoxide.
