29 CFR 1926.602(d), by reference to 29 CFR 1910.178(l)(1)(ii): Prior to permitting an employee to operate a powered industrial truck (except for training purposes), the employer shall ensure that each operator has successfully completed the training required by this paragraph (l), except as permitted by paragraph (l)(5). a.) On or about May 10, 2025, at 7575 McEwen Rd., Washington Township, Ohio 45459, the employer failed to ensure that an employee assigned to operate an all-terrain forklift had successfully completed the required powered industrial truck training and evaluation prior to being permitted to operate the truck. As a result, employees operating and working around the powered industrial truck were exposed to struck-by and caught-between hazards.

Each employee on a walking/working surface (horizontal and vertical surface) with an unprotected side or edge which is 6 feet (1.8 m) or more above a lower level shall be protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems. a.) On or about May 10, 2024, at a multi-family residential construction site, the employer failed to ensure that floor openings on the second and third levels were protected by a guardrail system. As a result, employees installing framing materials were exposed to fall hazards of 6 feet or more to the level below.

Each employee working on, at, above, or near wall openings (including those with chutes attached) where the outside bottom edge of the wall opening is 6 feet (1.8 m) or more above lower levels and the inside bottom edge of the wall opening is less than 39 inches (1.0 m) above the walking/working surface, shall be protected from falling by the use of a guardrail system, a safety net system, or a personal fall arrest system. a.) On or about May 10, 2024, at a newly constructed multi-family residential complex, the employer failed to ensure that wall openings on the second and third levels, where the inside bottom edge was less than 39 inches above the walking/working surface, were protected by a guardrail system. As a result, employees installing framing materials were exposed to fall hazards of approximately 23 feet 3 inches to the level below.
