29 CFR 1926.651(c)(2): A stairway, ladder, ramp or other safe means of egress was not located in trench excavations that were 4 feet (1.22m) or more in depth so as to require no more than 25 feet (7.62m) of lateral travel for employees: (a) Jackson Creek Parkway & CO 105: On or about July 2, 2025 the employer did not provide a safe means of egress for employees working in an excavation in excess of 7 feet deep. Employees were exposed to fall and cave-in hazards when exiting the excavation and having to step over an approximately 2 foot gap from the extension ladder, up to the edge of the excavation.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652 (b) or (c): (a) Jackson Creek Parkway & CO 105: On or about July 2, 2025, employees were exposed to cave-in hazards when they entered an excavation, which was greater than 7 feet deep, to cut a pipe. A Model 66-4SWLE trench shield had been placed in the excavation and only offered shielding on two sides.

29 CFR 1926.652(g)(1)(ii): Shields were not installed in a manner to restrict lateral or other hazardous movement of the shield in the event of the application of sudden lateral loads: (a) Jackson Creek Parkway & CO 105: On or about July 2, 2025, the employer did not ensure that each employee removing a pipe inside the excavation was protected from struck-by hazards from hazardous movement of the shield. The aluminum shield [Model 66-4SWLE] was not installed so as to prevent lateral loads from compromising the protective capacity of the shield system, in that it was installed so that gaps of more than 3 feet existed between the shield and the excavation walls.

29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could have resulted in possible cave-ins, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions: (a) Jackson Creek Parkway & CO 105: On or about July 2, 2025, the competent person did not perform adequate inspections of the jobsite to identify hazardous conditions involving an unprotected trench that was 15 feet in length, 12 feet wide, and of 7.3 feet deep with near vertical walls, in Type C soil. This condition exposed the employee to cave-in and entrapment hazards.
