Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from the recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a fall hazard while working from an elevated tree limb.    On or about July 8, 2025, at the North end of the work site, an employee was exposed to fall hazards while cutting limbs in a tree without fall protection.

29 CFR  1910.132(d)(1): The employer did not assess the workplace to determine if hazards were present, or were likely to be present, which necessitated the use of personal protective equipment:   On or about July 8, 2025, at the North end of the work site where an employee was not utilizing a fall protection system and the hazards were not identified and controlled while cutting tree limbs and branches from a tree.
