OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to carbon monoxide.  a) Bkon LLC, 858 North Lenola Road Moorestown, NJ 08057(Production Floor): On or about 9/11/2025, employees were exposed to carbon monoxide levels exceeding the 200ppm ceiling concentration as set by the National Institute for Occupational Safety and Health (NIOSH), and at least one employee was exposed to a concentration of 1730ppm, which exceeds the immediately dangerous to life or health level of 1200ppm set by NISOH.    NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1910.134(c)(1): A written respiratory protection program that included the provisions in 29 CFR 1910.134(c)(1)(i) - (ix) with worksite specific procedures was not established and implemented for required respirator use.   a) Bkon LLC, 858 North Lenola Road Moorestown, NJ 08057: On or about 9/11/2025, the employer did not develop and implement a written respiratory protection program with worksite-specific procedures for respirator use that included all provisions in 29 CFR 1910.134(c)(1)(i) - (ix). The employer required the Cellarmen to wear a 3M 6200 half face elastomeric respirator, throughout the shift while operating the grinder and the brewers.   NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR  1910.134(e)(1): The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace:  a)Bkon LLC, 858 North Lenola Road Moorestown, NJ 08057: On or about 9/11/2025, the employer did not provide a medical evaluation to determine an employee's ability to use a respirator before allowing its use.  The employer allows employees to voluntarily wear 3M 6200 elastomeric half face respirators when operating the coffee grinder.    NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
