29 CFR  1926.502(b)(1): The top edge height of the top rails, or equivalent guardrail system members, was not 42 inches (1.1 m) plus or minus 3 inches (8 cm) above the walking/working level:   a) 15200 Kutztown Road Kutztown, PA: On or about July 11, 2025, employees performed construction demolition cleanout near a third-floor (4th Story) wall opening where a guardrail system was being used for fall protection, and the top rail measured at 30 inches above the floor, exposing them to an approximate 40-foot fall.   b) 15200 Kutztown Road Kutztown, PA: On or about July 11, 2025, employees performed construction demolition cleanout near a second-floor (3rd Story) wall opening where a guardrail system was being used for fall protection, and the top rail measured at 35 inches above the floor, exposing them to an approximate 30-foot fall.   Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and state employees and their representatives were informed of this abatement.

29 CFR  1926.502(d)(21): Personal fall arrest systems were not inspected before each use for wear, damage, and other deterioration, and/or defective components were not removed from service:  a) 15200 Kutztown Road Kutztown, PA: On or about July 11, 2025, an employee performed demolition work near the third-floor cleanout opening, in the exterior wall, at a height of approximately 40 feet above the grade below. Defective fall protection equipment, such as the lanyard, was not removed from service and used when the cleanout guard rail was removed.   Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and state employees and their representatives were informed of this abatement.
