29 CFR  1926.1153(c)(1):For each employee engaged in a task identified on Table 1, the employer did not fully and properly implement the engineering controls, work practices, and respiratory protection specified for the task on Table 1, unless the employer assesses and limits the exposure of the employee to respirable crystalline silica in accordance with paragraph (d) of this section:  a) On or about July 14, 2025, employees were exposed to silica inhalation hazards while grinding and cutting on Belgard Manufactured Concrete Product (Belgard Shelton Wall 3pc Rio Antiqued) outside. The employee was using a hand-held grinder that was not equipped with either an integrated water delivery system or a commercially available shroud and dust collection system, per the engineering and work practice controls specified in Table 1. The employer failed to ensure employees were following Table 1 while shaving off additional concrete material using the hand grinder. There was visible dust during the cutting.

29 CFR  1926.1153(d)(2)(i): The employer did not assess the exposure of each employee who was or may reasonably be expected to be exposed to respirable crystalline silica at or above the action level in accordance with either the performance option in paragraph (d)(2)(ii) or the scheduled monitoring option in paragraph (d)(2)(iii) of this section:   a) On or about July 14, 2025, the employer, Cascade Design Inc DBA Denver Landscapes, did not assess the exposure of each employee engaged in grinding and cutting operations on Belgard Manufactured Concrete Product (Belgard Shelton Wall 3pc Rio Antiqued) which reasonably could be expected to expose employees to respirable crystalline silica at or above the action level.

29 CFR  1926.1153(g)(1): The employer did not establish and implement a written exposure control plan:   a) On or about July 14, 2025, the employer, Cascade Design Inc DBA Denver Landscapes, did not ensure a site- or task-specific written exposure plan was implemented to control employee exposure to respirable crystalline silica during required dry cutting and dry grinding of Belgard Manufactured Concrete Product (Belgard Shelton Wall 3pc Rio Antiqued) at 9522 Yucca Way, Arvada, CO 80007.
