29 CFR 1910.178(l)(1)(i): The employer did not ensure that a powered industrial truck operator was competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l).  Machine shop: On or about July 15, 2025, the employer did not ensure that a forklift operator was trained and certified to safely operate the the company forklift. The operator did not ensure that a manual pin that secured the fork to the machine was set and locked into position. Another employee was struck by a crane post when it fell to the ground after one of the forks detached and fell from the forklift.

29 CFR  1926.100(a): Employees were not protected by protective helmets while working in areas where there was a possible danger of head injury from impact, or from falling or flying objects, or from electrical shock and burns.  Machine shop: On or about July 15, 2025, the employer did not ensure that an employee who was struck in the head by the post of a gantry crane being lifted into position by a forklift was protected from overhead hazards by the use of a hard hat.
