29 CFR 1910.134(c)(1):A written respiratory protection program that included the provisions in 29 CFR 1910.134(c)(1)(i) - (ix) with worksite specific procedures was not established and implemented for required respirator use: At the concrete manufacturing facility located at 8451 E Trade Center Drive in Columbia MO, on or about July 15, 2025: Employees are exposed to inhalation of toxic and hazardous substances in the form of respirable crystalline silica dust, as well as skin conditions including but not limited to dermatitis and undetected other medical conditions. The employees were provided with Particulate Respirators N95 for voluntary use to wear as they deemed necessary. The employer did not develop or implement a written respiratory protection program to cover the operations prior to employees' use of a respirator including voluntary use.

The employer had not developed and implemented a written respirable crystalline silica dust exposure control program that included the description of the tasks involved, engineering controls, work practices, housekeeping and the use of respiratory protection.
