OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by and caught-in-between hazards: decedent   a) 401 Minnetonka Rd, Hi-Nella, NJ - A qualified arborist did not complete an assessment of the tree felling operation to determine possible hazards. The worker was attempting to free a hung-up tree which had fallen onto elevated communication lines by cutting the tree with a chain saw. When the cut was completed a 21 foot section of the tree suddenly dropped onto the bumper of the truck bed he was cutting from causing the worker to be thrown within the vehicle he was standing in and causing severe injuries. This condition was noted on or about July 17, 2025.  NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
