29 CFR 1910.147(c)(1): The employer did not establish a program consisting of an energy control procedure, employee training and periodic inspections to ensure that before any employee performed any servicing or maintenance on a machine or equipment where the unexpected energizing, startup or release of stored energy could occur and cause injury, the machine or equipment shall be isolated from the energy source and rendered inoperative:  (a) On or before July 23, 2025, employees who serviced or maintained any of the machines or equipment in the mill were not protected from injury due to hazards related to the unexpected energizing, startup or release of stored energy in that the employer did not establish a program consisting of an energy control procedure, employee training, and periodic inspections.

29 CFR 1910.178(p)(1): Powered industrial truck(s) found to be in need of repair, defective, or in any way unsafe had not been taken out of service until restored to safe operating condition(s):  (a) On or before July 23, 2025, employees operating a Nissan powered industrial truck (PIT) were not protected from being struck in that the brakes did not work, and the PIT had not been taken out of service until restored/repaired.  (b) On or before July 23, 2025, employees operating a Nissan PIT were not protected from being crushed in the event of a tip over in that the seat belt would not retract and could not be worn properly, and the PIT had not been taken out of service until restored/repaired.  (c) On or before July 23, 2025, employees operating a Hyundai powered industrial truck (PIT) were not protected from being crushed in the event of a tip over in that the seat belt would not extend and could not be worn, and the PIT had not been taken out of service until restored/repaired.  (d) On or before July 23, 2025, employees operating a Hyundai powered industrial truck (PIT) were not protected from being collisions and/or being struck by a PIT in that the horn was missing, and the PIT had not been taken out of service until restored/repaired.
