29 CFR 1910.147(c)(6)(ii): The periodic inspection certification of energy control procedures did not contain the required documentation on identification of the machine or equipment, inspection date, employees included, and the person performing the inspection.   a) On or about July 17, 2025, employees were exposed to hazardous energy, when the employer failed to ensure that periodic inspections of energy control procedures were properly documented, in which did not identify the machine or equipment involved, the date of the inspection, the names of authorized employees participating in the inspection, or the name of the individual who conducted the inspection, as required.

29 CFR 1910.147(d): The established procedure for the application of energy control (the lockout or tagout procedures) did not cover the actions listed in and was not done in sequence as required by 29 CFR 1910.147(d)(1)(6):  a) Tootsie Wrap Department - On or about July 17, 2025, an employee was exposed to machine hazards associated with moving parts when an employee sustained a laceration while clearing a jam at the overhead metal detector for the brown loop. The employer failed to implement energy control application steps as the machine was not shut down or turned off to perform the servicing work [per the 1910.147(d)(2) requirements]. As a result, the remaining applicable energy control elements, involving machine isolation [(d)(3)], Lockout/Tagout device application [(d)(4)], dissipation of residual energy [(d)(5)((i)], and verification of isolation [(d)(6)], were not implemented to protect employees from machine servicing hazards.

29 CFR 1910.212(a)(1): One or more methods of machine guarding was not provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks:  a) Tootsie Wrap Dept: On or about July 17, 2025, Employee #1, a general laborer, was manually cleaning candy near the Asset #7301 Overhead metal detector WHD Midgee for the brown loop conveyor belt when the employee slipped and fell, coming into contact with exposed moving machine parts. As a result, employee #1 sustained a laceration to their right bicep,  and remained hospitalized.
