OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall hazards:  a) On or about 7/22/2025 at a construction site located at 318 E. Fairmont Avenue, Lakewood, New York;  employees were working on a new commercial building from a platform on the forks of a rough terrain forklift. The platform was not approved for use to lift personnel by the forklift manufacturer, exposing employees to a fall hazards.  NO ABATEMENT CERTIFICATION REQUIRED

29 CFR 1926.453(b)(2)(v): A safety harness with lanyard attached to the boom or basket was not worn by employee(s) working from an aerial lift:  a) On or about 7/22/2025 at a construction site located at 318 E. Fairmont Avenue, Lakewood, New York; employees were working on a new commercial building from a platform on the forks of a rough terrain forklift. The employees on the platform did not have a harness with a lanyard attached to the boom or basket while operating the lift.  NO ABATEMENT CERTIFICATION REQUIRED
